1. Scope of Service
RadSrcOS provides a cloud-based digital infrastructure designed for the tracking and management of radiation sources. You acknowledge that the service is a facilitation tool only. It does not constitute legal, technical, or regulatory advice. The responsibility for the physical security, safety, and legal compliance of any radioactive materials remains exclusively with the Licensee.
2. Accuracy of Information
The Portal relies entirely on data input by the User. RadSrcOS does not verify, audit, or validate the accuracy of the information stored within the database.
Calculated Data: Any automated decay calculations or compliance reminders are provided for convenience.
Verification: You are mandated to independently verify all system outputs against physical inventory and calibrated instrument readings.
3. Limitation of Liability
To the maximum extent permitted by law, RadSrcOS (including its directors, employees, and affiliates) shall not be liable for any direct, indirect, incidental, or consequential losses arising from:
Regulatory Penalties: Any fines or legal actions taken against you by government bodies or radiation health authorities.
Data Integrity: Loss, corruption, or unauthorised access to data.
System Downtime: Inability to access the portal during critical inspections or audits.
Calculation Errors: Decisions made based on software-generated schedules or activity estimations.
4. No Professional Relationship
Your use of the portal does not create a consultant-client relationship. While the platform is designed with industry standards in mind, it is not a substitute for a qualified Radiation Safety Officer (RSO) or Radiation Management Plan (RMP).
5. Intellectual Property
All software architecture, code, branding, and proprietary algorithms remains the exclusive property of RadSrcOS. Users are granted a non-exclusive, non-transferable licence to access the portal strictly for internal business operations. Reverse engineering or unauthorised scraping of the platform is strictly prohibited.
6. Indemnification
You agree to indemnify and hold harmless RadSrcOS from any claims, damages, or legal expenses (including solicitor-client costs) resulting from your breach of these terms, your violation of any statutory radiation safety regulations, or your negligence in managing radiation sources.
7. Termination of Service
We reserve the right to suspend or terminate access without notice if we suspect fraudulent activity, failure to pay subscription fees, or use of the portal that jeopardises the integrity of the service or violates Australian radiation safety legislation.
8. Governing Law
These terms are governed by and construed in accordance with the laws of Western Australia. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of that State.
